Cold case suspect allegedly held victim's feet down during murder

Authorities have released new information in a cold case in San Benito where a murder witness was killed days before he was set to testify.
Court documents released Sunday show that Willie Martinez Guerra worked with Jesse Curly Rodriguez to kill murder witness Alex Villarreal.
Villarreal was a witness to a murder outside Harlingen TMs Club NCO back in October 2004.
Villarreal went missing but his body was found in a resaca outside San Benito in March 2005.
The court documents show that Rodriguez kidnapping Villarreal in Villarreal TMs Ford Mustang.
The documents show Guerra was in the backseat of Villarreal TMs car pointing a gun at him to keep him in line.
Villarreal reportedly begged for his life but Guerra is accused of holding Villarreal TMs feet down while Rodriguez shot Villarreal in the head.
Rodriguez allegedly fled to Matamoros where he allegedly sold the car, bragged about the murder and even showed people newspaper clippings.
Tamaulipas State Police arrested Rodriguez on carjacking and aggravated robbery charges.
Rodriguez ended up in Harlingen back in February where deputies arrested him.
Authorities filed a capital murder charge against Rodriguez on March 1st.
Both Rodriguez and Guerra remain in custody without bond.
The Cameron County District Attorney TMs Office announced that it intends to seek the death penalty against Guerra.
