Former Hidalgo County prosecutor arraigned on misdemeanor drug charges

A judge arraigned a former Hidalgo County prosecutor on misdemeanor drug charges Wednesday.

Municipal Judge Kathleen Henley arraigned former Hidalgo County prosecutor Ricco Diaman Delgado, 32, of McAllen — the son of state District Judge Rudy Delgado — on Wednesday morning.

Delgado is charged with two counts of possession and use of a volatile chemical, a Class B misdemeanor, and public intoxication, a Class C misdemeanor.

The arraignment marked Delgado's fourth run-in with the law during the past five months.

At 5:18 p.m. Tuesday, the McAllen Police Department dispatched an officer to the 1400 block of East Keeton Avenue, according to court records. Someone at the scene pointed the officer toward a black 2015 Dodge Dart.

The officer found Delgado asleep in the driver's seat. Delgado had several cans of Office Depot-brand cleaning dusters, which remove dust from keyboards and other electronic devices, on his lap.

"I also observed vomit on the drivers side door frame," according to court records.

The officer attempted to wake Delgado by gently shaking him.

"Immediately after the male awoke he grabbed a cleaning duster with his right hand and placed the cleaning duster in his mouth and attempted to spray," according to court records. "I quickly grabbed the duster out of the male's hand and asked him if he knew who I was. The male stated, 'Yes, the police.'"

The officer called an ambulance, which took Delgado to Rio Grande Regional Hospital.

While emergency medical technicians evaluated him, the officer checked with police dispatch — and learned Delgado had an active arrest warrant.

The warrant involved a Dec. 29 incident with virtually identical circumstances.

On Dec. 29, officers found Delgado asleep behind the wheel of a silver 2013 Mercedes Benz on the 900 block of East Expressway 83, according to court records.

Officers found cleaning dusters in the car and called an ambulance. Delgado required medical attention, which prevented police from immediately arresting him.

Along with the two incident involving dusters, Delgado is facing drunken driving charges from October.

> On Oct. 14, Delgado was booked on the charge of driving while intoxicated, a Class B misdemeanor.
Hidalgo County Justice of the Peace Jaime "Jerry" Muñoz set bond at $1,000 and jailers released Delgado the next day.
After the arrest, the Hidalgo County District Attorney's Office suspended Delgado without pay.
> On Oct. 23, Delgado was booked on the charge of inhaling or ingesting a volatile chemical, a Class B misdemeanor.
McAllen Assistant Municipal Judge Ricardo Montalvo set bond at $2,500 and jailers released Delgado the same day.
After the second arrest, Delgado resigned from the District Attorney’s Office.

Delgado remained at the Hidalgo County jail Wednesday afternoon. His attorney declined to comment on the charges
