Grand jury clears DPS officer in deaths of Guatemalan immigrants
A Hidalgo County grand jury has cleared a Texas Department of Public Safety (DPS) officer in the helicopter shooting deaths of two Guatemalan immigrants.
The October 2012 chase ended with the deaths of two Guatemalan immigrants after the officer fired at the back of the smuggler's truck from a DPS helicopter.
The back of the truck was covered by a tarp making it unclear what was in the bed of the pickup truck.
Hidalgo County District Attorney Rene Guerra told Action 4 News that he presented the fatal chase before a grand jury.
The grand jury issued a "no bill" clearing the DPS officer of any wrongdoing.
DPS officials refused to release video recorded from the helicopter, but officials with the Guatemalan Consulate in McAllen had called for a full investigation.
Guerra told Action 4 News that he agrees with the grand jury's decision and does not plan to present it again.
