A driver accused of running over and killing a La Feria businessman was out on bond for DWI at the time of the fatal accident.
La Feria police arrested 34-year-old Timothy Paul McGee on manslaughter and failure to identify charges back on April 9th.
McGee is accused in the death of 57-year-old Silvestre Juan Guajardo was killed in an accident off Expressway 83 and Solis Road.
The fatal wreck happened in front of the Guajardo TMs business, Cantera's, a brick and masonry company.
Court records obtained by Action 4 News show that McGee denied being the driver of the truck that killed Guajardo but lied about his identity to La Feria police.
The records show that McGee was out on bond for a DWI in Harlingen back in December.
Details about that arrest were not immediately available but Harlingen City Jail records show McGee was arrested for DWI on December 22nd, 2012.
La Feria police believe alcohol played a factor in Guajardo's death but are waiting on blood test results to see if charges against McGee will be upgraded to intoxication manslaughter.
Court records show that investigators used surveillance video from a nearby Whataburger and Shell gas station to identify McGee as the driver of the truck that killed Guajardo.
McGee remains in custody at the Cameron County Jail under $755,000 dollars in bonds.
