Man leaves injured brother in wrecked car

An 18-year-old Mission man was charged with a third degree felony Tuesday after he and his three friends allegedly left his 15-year-old brother on the side of the road after a car accident Sunday night.The 15-year-old boy is in critical condition including injuries to his head."It was just an accident, everyone can get in an accident," Obed Ozuna Pena said in the courtroom Tuesday.Pena was charged with an accident including personal injury or death, a third degree felony; and hitting a fixed object and leaving the scene, a Class B Misdemeanor.Speeding down the Frontage Road off 83 in Mission, police say the Ford Mustang hit a steel cable and slammed into a concrete barrier.Two female passengers were ejected.The fifth passenger left unscathed.Investigators say the driver and the three uninjured passengers had a friend pick them up before police arrived and failed to even dial 911."It is very severe, especially when you get in an accident involving injuries that you stay behind and provide first aid to the injured and wait for law enforcement to arrive and certainly call 911, Mission Police Chief Martin Garza said.Police say Pena fled the scene in fear he would be sent to prison because of his probation status in McAllen.He now faces five years in prison.The other passengers that fled the scene however will not be charged.This is not Pena TMs first run-in with the law, he was caught stealing a vehicle in McAllen and would have soon started his probation.
