San Benito dad jailed for DWI with 4-year-old son in car

A San Benito father is facing criminal charges after being arrested for driving while intoxicated with his 4-year-old son in the front seat.

San Benito police arrested 29-year-old Rene Garza-Gonzalez on a DWI with child passenger charge late Sunday night.

Investigators told Action 4 News that a police officer pulled Garza-Gonzalez over off FM 2520 and FM 800 on the city TMs southside.

The officer stopped Garza-Gonzalez for not having a working license plate light.

According to police, Garza-Gonzalez appeared intoxicated and his 4-year-old boy in the front passenger seat with only a seat belt.

Garza-Gonzalez allegedly failed a field sobriety test.

Officers turned the 4-year-old boy over the custody of a family member.

The San Benito father appeared before a judge on Monday morning where he was issued a $1,000 personal recognizance bond.

U.S. Immigration & Customs Enforcement (ICE) agents have filed a detainer against him.
