A man was arrested in San Benito after he allegedly tried to break into an apartment when he was intoxicated.

The San Benito Police Department responded to the attempted break-in, which happened on the 100 block of Gil Drive in San Benito.

Officers noticed the apartment door was damaged, but the suspect was nowhere to be found.

As the officer was gathering information from the woman, the man walked up to the apartment with blood shot eyes, according to San Benito Police Department.

He refused to identify himself and was placed under arrest, according to San Benito police.

The man was later identified by authorities as 25-year-old Jesse Abiel Gomez.

He was booked on charges of public intoxication, reckless damage, failure to identify and resisting arrest.

According to Gomez, his wife was the woman inside the apartment and he was not trying to break in.

He adds that he was not committing a crime, and he said had his wallet with his identification on him during the arrest.

He was arraigned by Judge Benjamin Yudesis and his bond was set at $3,500 plus a fine of $615 for resisting arrest and/or transportation.
