Two men have been formally charged for their roles in a drive by shooting that ended in a fatal auto accident just outside of McAllen.
Hidalgo County Sheriff's Office deputies arrested both Armando Loya and Heriberto Villalpando on deadly conduct charges early Wednesday morning.
The two are accused of participating in a drive by shooting at 11116 North Mayberry Road just north of McAllen.
Witnesses said four men fled the scene in a vehicle but got into an accident just south of Highway 107.
Deputies confirmed that 23-year-old suspect Omar Lucio Zuniga died in the accident.
Both Loya and Villalpando tried to flee the scene but were arrested walking away from the accident.
Paramedics rushed the driver to a local hospital where he remains in custody.
The driver's name has not been released but he's expected to face a deadly conduct charge for the drive by shooting and a murder charge for Zuniga's death because the accident happened while fleeing a felony.
Deputies reported find a handgun and an assault rifle at the scene of the accident.
An exact motive for the drive by shooting is not clear but court records show that Loya had threatened to kill the homeowner and his family.
