Video clears sheriff's son from assault on public servant charge

One out of three criminal charges has been dropped against the son of Hidalgo County Sheriff Lupe Trevio.

A grand jury recently handed down a no bill against John Carlos Trevio.

Arrested back in July for public intoxication, resisting arrest and assault of a public servant.

Trevio was accused of getting rough with a jailer at the McAllen Police Department.

But Hidalgo County District Attorney Rene Guerra said video evidence told the grand jury a different story.

"In this case, they saw what I saw in the video, Guerra said. The video didn't corroborate the officer's statement. The video shows he was wrestled to the ground in the McAllen booking area."

Trevio's legal advisors have requested an internal investigation.

Guerra said he's appointed a special prosecutor to handle the resisting arrest charge.

The public intoxication charges remains pending in McAllen Municipal Court.
