Woman charged with boyfriend's death after he fell off trunk of car

A woman is behind bars following a fatal accident where police say she had been drinking and driving with her boyfriend sitting on the trunk of her car.

McAllen police arrested 29-year-old Rosa Guadalupe Herrera on an intoxication manslaughter charge early Monday morning.

Investigators told Action 4 News that police officers were called out to an autopedestrian accident off West Daffodil Avenue near Ware Road at 12:12 a.m. Monday.

Police officers found 21-year-old Gersain Gutierrez still alive but on the ground.

Paramedics rushed Gutierrez to the McAllen Medical Center where he died.

Investigators learned that Herrera and Gutierrez got into an argument on nearby North 31st Street.

Herrera drove away in a Saturn Aura but Gutierrez allegedly got on top of the trunk of the car.

Police said Herrera kept driving with Gutierrez on the trunk of the car until he fell off on the 3000 block of West Daffodil Avenue.

Herrera remains in custody at the Hidalgo County Jail under a $150,000 dollar bond.
