The Donna School District is being sued by a former employee.

Roy Padilla, the former police chief for Donna I.S.D., says he was wrongfully terminated and now is suing them.

According to the lawsuit, Padilla claims Donna I.S.D. terminated him in 2017 for what he alleges was due to his race and age.

Donna I.S.D. Board decided Tuesday night to obey by their attorney’s recommendations and move forward with a settlement.

One of the attorneys for Donna I.S.D. says the settlement is not finalized but will be moving forward to resolve the case with Mr. Padilla. It will likely take about 30 days to come to an agreement.

Padilla has already been terminated twice by the district.

He was let go in May of 2014 but rehired later that year in December after he sued the district and won.

He is suing the district again under race and age discrimination, which is listed in the lawsuit as Title VII and the Age Discrimination in Employment Act.

Padilla told CBS 4 before the board made a decision on the settlement that he would be abide by any decision they would come up with.

The current Donna I.S.D. Police Chief is Daniel Welden and he previously served as Interim Chief of Police for Donna I.S.D.
